Most servicers wait until you’re 90 days past due before they refer the file to a foreclosure attorney. Federal rules generally stop them from starting foreclosure before 120 days of delinquency.
Notice of default
For a homestead, Texas law gives you at least 20 days to cure. Pay the full past-due amount plus fees and the loan goes back to normal. Miss the deadline and the lender can accelerate, meaning the entire balance is due at once.
Notice of sale
The trustee mails you a notice of sale, posts it at the county courthouse, and files it with the county clerk at least 21 days before the auction. In Bexar County, that posting appears at the Paul Elizondo Tower.
Auction day
Texas foreclosure auctions happen on the first Tuesday of the month, between 10 a.m. and 4 p.m., at the county courthouse or a designated site. The highest bidder, often the lender itself, takes the deed. There’s no right of redemption after a Texas mortgage foreclosure.
Eviction and deficiency
You become a tenant at sufferance and can be removed through a forcible detainer case in a matter of weeks. If the house sold for less than you owed, the lender has two years to pursue a deficiency judgment against you for the gap.
